I am an E9 visa worker. I am going to leave Korea after 4 years and 10 months. How is the severance pay (Toejiggeum) calculated?
First of all, I will explain the severance pay. The severance pay is calculated based on the average wage for 3 months before retirement. For example, if you received 2.5 million won in July, 2.7 million won in August, and 2.3 million won in September, the average for three months is 2.5 million won. If you have worked for 4 years, multiply the average monthly salary for 3 months by 4. So, the severance pay is 10 million won.

Severance pay is an amount of money that an employer is going to pay an employee when they’re severed from employment. If an employer terminates an employee, sometimes there’ll be an employee contract. If that employee had negotiated severance pay, that’s the amount of money that will have to be paid if the employer terminates.
Now sometimes if the termination is for good cause, the contract with that employee will say \”no severance is due if you’ve been terminated for good cause\” as opposed to just letting that employee go. Sometimes, it just is best if you want to recruit an employee and they are moving here from another state, they’re giving up a good job, they want the assurance that if they come and work for you that 3 months later, you’re not just going to fire them. And then they have no money to cover them during the period of time that they have to look for another job.
Severance can also be paid when there’s a dispute or fight over whether you should be firing someone or not. The employee feels they’ve been wronged and you pay them a severance, just sort of settle the dispute with that employee so that they waive their right to sue you in exchange for paying them severance money.
